The VAT rules for selling a company car differ depending on whether you sell to a professional dealer or a private individual. Correct handling saves you administrative headaches and potential additional assessments.
If you sell your company car to a VAT-registered buyer, you generally charge VAT on top of the sale price. The buyer offsets that VAT through their own return. You must issue an outgoing invoice stating your VAT number and the VAT rate (usually 21%). The buyer can deduct the VAT if they use the car for business purposes.
When selling to a private individual, you may not state VAT separately. The price includes VAT and you must process the VAT correctly in your periodic return. You receive the full amount, but you remit the VAT. Note: if you originally purchased the car with VAT deduction, you must pay VAT on the sale value when you sell. The private individual has no VAT recovery.
If you sell the company car to a buyer in another EU country with a valid VAT number, the zero-rate scheme may apply. You invoice without VAT and state 'intra-community supply' on the invoice. Make sure to verify the buyer's valid VAT number and include the supply in your VAT listing. Incorrect use leads to fines.
Keep the following documents at hand: the original purchase invoice, the registration certificate and any VAT return on which the car is listed. When selling to a buyer, they often help with the formalities, which reduces the risk of errors. Nevertheless, you remain responsible for the correct VAT remittance. When in doubt, consult your accountant or tax advisor.
